Article 1. Applicability of Terms
On all offers, quotations, orders, sales and deliveries of articles by Miniatuurshop.com, with offices in Apeldoorn at Landmetersveld 219, 7327KN in Apeldoorn, email address [email protected], VAT number NL1001378476B89, registered in the Trade Register of the Chamber of Commerce in Apeldoorn under number 60000643 to customers (which in these terms of delivery also includes potential customers) and all agreements in this regard and related thereto, these terms of delivery apply.

Article 2. Agreement
The agreement between Miniatuurshop.com and the customer is in all cases first established either (i) at the time of written confirmation (including electronic confirmation) of the content of the agreement by Miniatuurshop.com, or (ii) on the day that Miniatuurshop.com has started the execution of the agreement, or (iii) at the moment that the customer places an order via the online order system, depending on which of the situations indicated above under (i), (ii) and (iii) occurs first.

Article 3. Information Obligations
The provisions of this article apply to customers who are natural persons and who do not act in the exercise of a profession or business. Miniatuurshop.com cannot be held accountable for deviations in prices and texts. Price changes are reserved. This means that prices may differ from the price shown on our site. In the case of a reservation, the customer has the right to cancel it.

When reserving a new model, a deposit of € 25.00 per model will have to be paid in advance. In case of cancellation of a new model, the deposit costs will not be returned.

Miniatuurshop.com ensures that the delivery conditions before or at the conclusion of the agreement to the customer, whether or not electronically. The customer is responsible for saving and printing the terms of delivery and the agreement, if desired, by means of facilities available for this purpose on the Website, in the customer's browser or otherwise, and for the (permanent) accessibility of the stored copies.

Without prejudice to any legal obligations existing for Miniatuurshop.com to keep the agreement and / or the terms of delivery, Miniatuurshop.com is not obliged to keep any archived agreement and / or the terms of delivery accessible to the customer.

The customer has no right to return the products for second-hand products.

In the case of New products, the customer has the right to dissolve the agreement for any reason within 14 days after receipt of the article. In that case, the customer must return the article in its original condition to Miniatuurshop.com and to the address indicated on the Website. The costs of return are at the expense of the customer.

Article 4. Deliveries and Associated Costs
The items ordered and paid for by the customer, which are in stock, usually take place within 2 working days, but no later than 5 working days after receipt of the amount due and will take place at the address provided by the customer. Goods that are not in stock will usually be sent within 1 working day, but no later than 3 working days after arrival to the address provided by the customer. 

If goods are not in stock, this will be reported to the customer in the online order overview before payment. Goods delivered on account must be paid immediately, unless otherwise agreed in writing. Fixed shipping costs have been determined for delivery. These can be found in the table as stated on the website.

Shipping rates are subject to change without notice. The rates in the Miniatuurshop.com online ordering system are leading.

Article 5. Privacy
The personal data provided by the customer will only be processed for the implementation of the agreement and / or these delivery conditions. The customer's personal data will not be used for other purposes or provided to third parties, unless Miniatuurshop.com is obliged to do so by virtue of a legal obligation. Article 6. Retention of Title
All items remain the property of Miniatuurshop.com until full payment has been received for the goods and any additional costs.

Article 7. Applicable Law
Dutch law applies to the agreement between Miniatuurshop.com and the customer as well as these delivery conditions. Disputes between Miniatuurshop.com and the customer on account of any agreement and / or the terms of delivery or those related thereto will only be settled by the competent court in Arnhem. Neither the agreement nor the general terms of delivery intend to prejudice any applicable provisions of mandatory law.
